Felony Assault with a Firearm on a Law Enforcement Officer charge reduced to a Class 3 Misdemeanor
A Browning & Long client was charged with numerous crimes including a serious felony after he allegedly threatened and pointed a handgun at a Charlotte Mecklenburg Police Officer.
The Facts
The police responded to our client’s home after a neighbor called 911 indicating that our client was firing his handgun in his backyard. When the police arrived, they alleged that our client pointed a gun at them and threatened them. Our client was placed under arrest and charged with Felony Assault with a Firearm on a Law Enforcement Officer (Class E Felony with a maximum punishment of up to 63 months in Jail) and Assault on a Government Official (Class A1 misdemeanor with a maximum punishment of up to 5 months in Jail). Altogether, our client was facing over six years in prison.
The Result
Mr. Long negotiated with the Mecklenburg County District Attorney’s Office and our client simply had to plead to a class 3 misdemeanor. His only punishment was paying a fine and court cost. He was not placed on probation and all his other charges where dismissed.
